If You Know You're Innocent, I'll Help You Keep Fighting.
Spokane, Washington, Criminal Appeals Lawyer
Whether you have accepted a plea agreement or have been found guilty in a court trial, the conviction and sentence will stand until you have exhausted all opportunities for appeals. Do you believe that everything occurred by the book throughout your arrest, arraignment and trial? Mistakes happen.
I am Bryan P. Whitaker, Attorney at Law. State and federal appellate laws can become complex and are often frustrating. I don't push filing for an appeal just to buy you more time. The fact is, though, that police, prosecutors, judges and juries often commit mistakes that violate your constitutional rights. An appeal is the next opportunity you have to express to a court that a mistake was made and that error affected the outcome of your case.
The Judge Won't Admit a Mistake. It Takes a Fight in the Court of Appeals.
Because of the complexity of the investigation required, not every criminal defense attorney will handle appeals. An effective appeal requires a close examination of the complete body of evidence, police records and procedures, and the way the judge handled the decisions and motions from the opposing attorneys. Taking your case to a court of appeals means that you will be asking the judge to question the reasoning that went into the decisions made during your case at trial. It may even be about changing the law, which could have a bearing on future cases under similar circumstances. A successful criminal appeal takes a knowledgeable, experienced lawyer who has the fortitude and skill to fight through an appeals system that often appears stacked against you. I have that fortitude. I have the professional skills and resources. I know what I'm doing.
